Local paving company fined for illegal fly-posting

On 23 June 2021, following a successful prosecution by the Council, a local landscaping company, T&R Paving Limited, was sentenced for seven offences under advertisements regulations.

Epsom & Ewell Borough Council's Chair of the Environment and Safe Communities Committee, Councillor Neil Dallen said, "Epsom & Ewell Borough Council strongly discourages illegal fly-posting and advertising in the Borough. Every step is taken to prosecute offenders and the fines set down by the Courts are usually substantial."

The offence of unlawfully displaying advertisements under the Town & Country Planning (Control of Advertisements) Regulations carries a financial penalty of up to £2500. Putting-up of advertising hoardings, posters and other outdoor advertising is carefully regulated to control unsightly and ugly advertisements and manage amenity and safety considerations. When displayed near main roads, they are generally a danger because they distract the attention of road users.

T&R Paving were fined £1500 for each offence totalling of £10,500, which is payable together with a surcharge and the Council’s full costs incurred investigating and prosecuting the case.

Cllr Dallen added, "It is important to report illegal advertising to the Council. In this case, the Council was able to enforce following reports of this issue and we would like to thank those members of the public who reported this issue to us. We will continue to prosecute repeat offenders and offences."
