The information that you need
Every time a property or a piece of land is purchased, leased or a valuation carried out, a Search is sent to the Local Authority in whose area the sale lies. The reason for this is to check if there are any matters affecting the property or land, registered as a local land charge or information held by the Council, which the buyer should know about.
The search will be in two parts:-
- the first part, called the LLC1, deals with all the registerable charges (for example financial charges registered against the property by the local authority), improvement grants, tree preservation orders and planning agreements;
- additional enquiries in a standard form known as the CON29R deal with issues such as road schemes, the planning history of the property and enforcement notices which affect the property.
Submission of search
Both the LLC1 and CON29R forms should be submitted at the same time if answers to both are required. Please note that searches must include the following when submitted to be accepted for processing:-
- the correct fee;
- if a search is submitted by a solicitor, cheques drawn on the solicitor's client account are preferred, although not essential. Cheques should be made payable to Epsom & Ewell Borough Council;
- a correct and clear address to be searched against;
- a scaled, up-to-date site plan showing the boundaries of the property or land to be searched against, clearly marked in red (This is not essential if the search is against a single residential address).
PART II additional enquiries
You may, of course, add your own additional enquiries to the standard search and our replies will then be returned with your search. If you have any additional questions following your search, you can write to us. This will incur an additional charge of £20.00 for each question answered.
Personal searches
Personal searches of the Land Charges Register can be made by visiting the Town Hall during office hours and preferably by appointment.
NB. This is not a full search.
For £11.00 you will receive a printout of any charges held on the Land Charges Registers.
Cancellation of searches
We regret that we cannot cancel searches once received, as work will have already commenced.
Turn round times & processing of searches
Our aim is to turn round standard searches within 4/5 working days from the date of acceptance of the LLC1 and CON29R forms.
Scale of Fees
The standard search fee for a Certificate of Search (LLC1 form) and enquiries (CON29R form) relating to one parcel (a dwelling or piece of land) is £200.00. Two plans are always required if the property is industrial. If residential, no plan is usually required.
