Smoke free public places: What does it mean?

Since 2007, smoking has been prohibited in nearly all enclosed or substantially enclosed workplaces or public areas.  Company vehicles used by more than one person must also be smoke free. The law also means that indoor smoking rooms are no longer allowed.  So anyone wishing to smoke will have to go outside instead.

In addition, smoke free premises have to display a "prominently visible" no-smoking sign at each public entrance to the premises.

Guidance and signage have been issued by Government to businesses.  Advice and enforcement within the Borough will be carried out by Environmental Health Officers.

What are businesses required to do?

It is the business owner’s responsibility to ensure a smoke free environment for both their staff and customers.  Failing to prevent smoking in a smoke free place, or smoking in a smoke free place, will be an offence and could lead to a fine.

Can I install a shelter for my staff or customers?

It is possible to install a shelter for those who wish to smoke, but any structure must not be substantially enclosed or it will be considered smoke free and smoking will need to be prohibited.  Therefore we recommend you contact us before installing any type of shelter and additionally you should speak to our planning department, as most shelters will require planning permission.

The NHS Stop Smoking website gives you free quit tools and aids to help you stop smoking cigarettes or tobacco for good.
