Do I need a Licence?
If you own premises where 'Amusement with Prizes' machines are to be used, you will require a licence to do so from the Local Authority, or from the Magistrates Court or from the Gaming Board.
Licences are issued under the Gaming Act 1968, Section 34 (1) or Section 34 (5e), dependant upon the type of machine being used and the amount of the cash payout.
Section 34 Permits are only issued to amusement centres. The siting of gaming machines in any other type of premise within the Borough (such as in a take away) is prohibited.
Section 34 (1) permits 'Amusement with Prizes' machines that charge a maximum 30p per play, and which have prizes not exceeding £5 in cash or £8 in tokens.
Section 34 (5e) permits larger payouts of up to £25.
Permits issued by the Courts or Gaming Board may allow for higher amounts.
Gaming Act Permits in Public Houses
If you already hold a Gaming Permit issued by the Magistrates Court, the new Licensing Act 2003 prescribes that you must transfer this to a Local Authority Gaming Permit.
How do I apply?
You must complete the application form and send it to the Town Hall, The Parade, Epsom, KT18 5BY, together with the licence fee of £32 for Section 34 (1) applications or £250 for Section 34 (5e) applications, (2005 – 2006 rate). Cheques should be made payable to Epsom & Ewell Borough Council.
